The International Federation of Consulting Engineers (FIDIC) has issued a number of standard forms of contract for use on construction and engineering projects.
With pleasure BUiD welcomes Prof. Nael Bunni back to deliver a second expert lecture on FIDIC. For those who attended last year, this will be an interesting update. As for the new guests, they will have a thorough introduction.
This special presentation on "Dispute Resolution Mechanisms under the FIDIC Conditions of Contract" has been prepared to offer a complete up-to-date review of the effective understanding and use of the relevant Clauses within the FIDIC suite of Contracts. It will touch upon the following topics
- Pre 1999 – Clause 67;
- Post 1999 – Clause 20;
- An in-depth analysis of each Sub-Clause contained therein – what it says, what it means and what result should be derived from it;
- The Gap within Sub-Clause 20.7 of the 1999 Forms of Contract;
- Rectification of the Gap within Sub-Clause 20.7; and
- The future of Clause 20 of the FIDIC Conditions of Contract
About the speaker:
Prof. Dr. Bunni is a Chartered Engineer, Registered Chartered Arbitrator and Conciliator/Mediator.
He is a member of the Commission on International Arbitration of ICC, Paris, and a number of its Standing Committees; a member of the Board of Trustees of the Dubai International Arbitration Centre and Chairman of its Executive Committee; and a Special Adviser to the FIDIC Contracts Committee. Between 1994 and December 2007, Dr. Bunni was a member of the Board of Directors of the London Court of International Arbitration; Chairman of The Dispute Resolution Panel of the Institution of Engineers of Ireland
He has acted as dispute board member, conciliator/mediator, arbitrator or chairman of arbitral tribunals in numerous domestic and international disputes involving parties from over fifty jurisdictions. As arbitrator, in over one hundred and thirty cases of dispute, either as sole arbitrator or as a member of a tribunal or as chairman of an arbitral tribunal. Many of these appointments were under the ICC Rules of Arbitration; the LCIA Arbitration Rules; the UNCITRAL Arbitration Rules; the Rules of the Cairo Regional Centre for International Commercial Arbitration; or the Dubai International Arbitration Centre. Over eighty of these cases have led to written and rendered reasoned awards.
